Welcome to InkBrook.

InkBrook is a personal memory and learning tool developed and operated by Dalian Junjing Xiyu Technology Co., Ltd. (大连峻境溪语科技有限公司) ("we"). These terms are the agreement between you and us about using the app. Please read them in full before use.

Please pay particular attention to the sections that affect you most—Section 6 "Payment and subscription," Section 7 "Disclaimers and limitation of liability," Section 8 "Changes and termination of service," Section 11 "Governing law and dispute resolution," and Section 12 "Relationship with Apple." They concern your rights and our respective responsibilities; make sure you understand them before using the app. If you disagree with any part, please do not install or use the app.

By tapping "I've read and agree" during onboarding, or by downloading, installing, opening, or using InkBrook, you confirm you have read, understood, and accepted these terms in full. Together with our Privacy Policy they form the complete agreement for your use of the app; where they overlap, the Privacy Policy prevails on personal-information matters.

If you are a minor, please read and accept these terms accompanied by, and with the informed consent of, your guardian (see Section 9).


1. Definitions

To keep these terms clear, a few words are defined up front.

2. The service

1. InkBrook is a study tool that helps you manage your own memory. Its core: after each study session you write, in your own words, what you learned and what is still unclear, and the app reminds you to self-test at the right time so knowledge sticks long-term.

2. The app is a tool, not an education product. It does not create exercises, teach lessons, or provide any teaching content. Everything you review in the app comes from records you created; we provide no courses, question banks, or answers.

3. It is a tool for your own use. Your account and data are fully under your control—view, export, or delete them anytime.

4. The app serves learners of all ages, positioned as a productivity/utility app, not directed at any particular age group, and not an education or training product.

5. You can use the app offline. It runs local-first: your study data stays on your device by default. We have no servers, collect none of your study data, and cannot see it. Networked capabilities (sign-in, optional iCloud sync, in-app purchase, speech recognition) are Apple system services under Apple's terms and privacy policy. Speech recognition is provided by Apple and may in some cases send your audio snippets to Apple for processing (some devices support on-device recognition); see the Privacy Policy and Apple's documentation for details.

6. The app may request camera, microphone, speech recognition, and notification permissions as you use the corresponding features (photographing problems, dictating summaries, review reminders). See the Privacy Policy for each permission's purpose and timing; manage them anytime in iOS Settings.


3. Account and sign-in

1. Using the app requires Sign in with Apple. You can sign out anytime; to clear everything, use "Delete local data and sign out" in Settings.

2. The sign-in method is Sign in with Apple. Apple's service performs the identity verification (an Apple system service); we have no sign-in servers and upload none of your sign-in information anywhere. After sign-in the app stores only the Apple-issued user identifier on your device (in the system Keychain, this device only, not synced via iCloud Keychain); if you chose to share, the email and name Apple returned are also stored locally (the email may be a private relay address).

3. You can sign out anytime on the settings page. Signing out clears only the locally stored Apple identity and never affects or deletes your study data.

4. Since the app has no backend account system, your account and data live entirely on your own device (and, with iCloud sync on, in your own iCloud private database). Keep your device and Apple Account safe; consequences of a lost device, use by others, or a compromised Apple Account are your responsibility.

5. iCloud sync is optional and off by default; only you can enable it, and three conditions must all be met: (1) you flip the sync switch; (2) you confirm "I am 14 or older with guardian consent"; (3) you unlock the paid entitlement.

Enabling iCloud sync means your study data (which may include problem photos, transcribed text, and other personal information) will sync to your own iCloud private database hosted by Apple iCloud. This processing requires your separate, explicit consent: flipping the switch and completing the confirmations constitutes that separate consent to have Apple host the data under your Apple Account. The data serves only to align your own devices and is processed by Apple under its terms and privacy policy; we have no servers and can neither receive nor see it. For details, see the corresponding entries in the Privacy Policy.


4. Acceptable use

Please observe the following when using the app.

1. Lawful use: comply with applicable laws and regulations; do not use the app for anything illegal or that infringes others' rights.

2. Genuine content: the app records your own study. Enter content related to your actual learning—no false, illegal, or study-unrelated improper material.

3. No abuse: do not reverse-engineer, decompile, or crack the app, circumvent the payment mechanism, or interfere with the normal operation of the app or Apple system services.

4. No infringement: your text, photos, and audio must not violate others' portrait rights, privacy, intellectual property, or other lawful rights. If your content involves others (e.g., a photo includes someone else), make sure you have the necessary consent.

5. Own responsibility: you are responsible for what you enter and store. Since the data lives mainly on your device, keep the device secure and back up your data.

6. Export control and sanctions: you represent and warrant that you are not located in a country or region under a U.S. government embargo or designated as "supporting terrorism," and that you are not on any U.S. government list of prohibited or restricted parties.

You bear the consequences of any use that violates the above.


5. User content and intellectual property

1. What you create is yours. Ownership of and rights in the user content you enter—study goals, summaries, review cards, quick jots, photos, transcribed text—belong to you; we claim no ownership.

2. For the app to work, you authorize it to store, display, organize, and sync your content on your device and, with iCloud sync on, in your own iCloud private database. This authorization exists solely to deliver the app's features to you, limited to the minimum necessary; it transfers no ownership to us and permits no use beyond the features.

3. The app's own intellectual property is ours. The software, interface design, copy, icons, color schemes, and names and marks such as "InkBrook" (溪语记忆卡) are protected; without written permission you may not copy, modify, distribute, or use them commercially.

4. Some bundled assets (avatar illustrations, sounds) come from openly licensed commercial-use sources; rights remain with their authors, used under their license terms.


6. Payment and subscription

1. InkBrook uses auto-renewing subscriptions, billed monthly or yearly, each with a 7-day free trial: all features are free during the trial, which auto-renews when it ends until you cancel. The free trial is available once per Apple Account (monthly and yearly share the same trial); accounts that have used it are charged immediately upon confirming a new subscription.

2. Feature tiers, so you can try before deciding:

After expiry or cancellation the app returns to the free version. Your local study data remains intact and reviewable—never deleted or locked (except batch-imported cards: scheduling pauses while unsubscribed, content stays browsable, resubscribing restores it); only the Premium features above lock again. Note that the free version's "free" presumes the app remains in service; if the app is delisted or shut down entirely (see Section 8), the service ends accordingly. You can subscribe anytime to unlock everything.

3. Auto-renewal and cancellation: the subscription renews and charges before each billing period ends unless you cancel at least 24 hours before the period ends. Manage or cancel anytime in Settings › your name (Apple Account) › Subscriptions; cancellation takes effect at the end of the current period, and the current period is not refunded.

4. Apple App Store collects payment. We never collect or store your payment account or card details.

5. Refunds go through Apple's channels under Apple App Store rules. We do not handle refunds separately and cannot process them in Apple's place.

6. After switching devices or reinstalling, use the same Apple Account and Restore Purchases in the app to recover your subscription.

7. Where Apple's conditions are met, the subscription supports Family Sharing (as applicable).

8. Pricing: launch pricing is a limited-time offer and may change. The actual price at any time is what the App Store shows when you purchase.

9. Payment should be completed by an adult with the corresponding legal capacity; minors should pay only with guardian consent (see Section 9).


7. Disclaimers and limitation of liability

Please read this section carefully.

1. The app is a tool that helps you manage memory. Its review reminders and pacing are aids for building study habits, not professional educational, medical, or psychological advice. For professional needs, consult qualified professionals.

2. Learning varies from person to person. The app helps you record and review in a more organized way, but actual outcomes depend on your effort, foundation, methods, and more; we guarantee no specific results.

3. The app is provided "as is." We make reasonable efforts to keep it stable, but to the extent permitted by law we do not warrant it will be error-free or uninterrupted.

4. Because the app runs local-first with data mainly on your device, to the extent permitted by law we are not liable for data loss caused by device damage or loss, system failures, accidental deletion, or missing backups. Please export backups regularly.

5. To the extent permitted by law, we are not liable for indirect losses arising from your use of, or inability to use, the app. Nothing here excludes or limits liability that cannot be excluded or limited by law.

6. Force majeure and third-party outages: where force majeure (natural disasters, changes in law or policy, etc.) or failures, interruptions, or changes in third-party system services the app relies on (Apple iCloud, the App Store, speech recognition, etc.) render some or all features unavailable, we are not liable to the extent permitted by law, but will make reasonable efforts to help reduce the impact.


8. Changes and termination of service

1. We may update, improve, or adjust features in light of product development, technical changes, or legal requirements. For changes that materially affect you, we will notify you via in-app notices, release notes, or other appropriate means.

2. We may suspend or terminate some or all of the service in reasonable circumstances (e.g., the app is delisted or shut down entirely). If so, we will make reasonable efforts to notify you in advance and to preserve a way for you to export your local data.

3. You may stop using and uninstall the app at any time. Uninstalling clears the app's local data—back up first if needed.

4. If you violate these terms, we may restrict or terminate your use of the relevant features.


9. Minors

1. The app serves users of all ages and is not designed specifically for minors (see Section 2).

2. If you are a minor, use the app—including any purchases—with your guardian's knowledge and consent.

3. If you are a child under 14, a guardian should read these terms and the Privacy Policy and consent on your behalf before you use the app. The guardian may help manage, edit, or delete the data produced.

4. If you are a guardian and find a minor using the app or incurring charges without your consent, contact us via Section 13 and we will assist under the applicable rules.


10. Updates to these terms

1. We may update these terms from time to time. Updates carry a new effective date; for material changes we will notify you via in-app notices or other appropriate means.

2. Updated terms replace prior versions once effective. Continuing to use the app after an update means you accept it; if you disagree, stop using the app.


11. Governing law and dispute resolution

1. The formation, effectiveness, interpretation, and dispute resolution of these terms are governed by the laws of the People's Republic of China (excluding conflict-of-law rules).

2. Disputes between you and us over these terms or the app should first be resolved through friendly consultation; failing that, you may sue in a people's court with lawful jurisdiction, such as where our operating entity is located, where the contract is performed, or where you reside.

3. If any provision is held invalid or unenforceable, the remaining provisions stay in force.


12. Relationship with Apple

The app is distributed through the Apple App Store, so as between you and Apple:

1. These terms are between you and us only; Apple is not a party and bears no responsibility for the app.

2. Apple has no obligation to provide maintenance or support for the app; we are responsible for maintenance and support.

3. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation for the app.

4. Product-liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims under consumer-protection or similar laws are our responsibility, not Apple's.

5. If a third party claims the app, or your possession and use of it, infringes intellectual-property rights, we—not Apple—are responsible for the investigation, defense, settlement, and discharge of the claim.

6. Apple and its subsidiaries are third-party beneficiaries of these terms; upon your acceptance, Apple has (and is deemed to have accepted) the right to enforce them against you as a third-party beneficiary.

7. Your use of the app is also subject to the Apple App Store Terms of Service and Apple's applicable usage rules.
